(a) Chandi an Indian has been carrying on business in Nigeria for over ten years. Recently he was discovered to have imported several goods into Nigeria
without paying the appropriate Custom and Excise duties on the goods. He was arrested detained and tried before the Federal High Court. In his defense he
stressed that since he is not a Nigerian he ought not to be tried under Nigerian laws but rather the Indian laws should be applied to him simply because
he had stayed over ten years in Nigeria. In addition since India and Nigeria are both Commonwealth countries they have a common source of laws.
