Prison inmates sentenced to die by lethal in- jection sued the Food and Drug Administra- tion for refusing to take action against the makers and users of the drugs used for lethal injection. That is the prisoners claimed that the drugs violated FDA standards and thus should be subject to an enforcement action to prevent violations of FDA rules. The FDA claimed that it did not have to review drugs or undertake enforcement actions that it did not think necessary. The prisoners claimed that the FDA had to hold all drugs to the same stan- dards and that enforcement action had to be taken. Were the prisoners correct?
