The Jackson Michigan Board of Education had a rule that in the event of a cutback in teachers the layoffs would be proportional on the basis of race. That way students would be guaranteed more minority teachers as role models. This was done because more of the older teachers were white; if the layoff was based on seniority only more minority teachers would be laid off in proportion to the white teachers. The district court and court of appeals agreed with the school board saying the rule helped to remedy past discrimination. What do you think the Supreme Court held?
